All users of the Virtual Gifts Service (Hereinafter as "the Service") are required to fully understand, accept and agree to the Policy of the service (Hereinafter as "the Policy"), which is part of the Terms of Use of the site. Violation of the Policy or prohibited acts carried out by any member may, at any time, lead to the suspension or termination of use of the Service and the removal of his profile from the site. Basic Rules for Virtual Gifts:

• You fully understand how the Service works and accept that it is used to send computer generated animations/images as gifts to other members only. Virtual Gifts is a paid service for which you must pay with Credits and accept the price of each item you send. You only pay when the Service is used so no refund requests are accepted.

• If the member who receives your Virtual Gifts is interested in you, you will receive a reply via our EMF Mail Service. The member can also send Virtual Gifts to you via EMF Mail, which are free for you to receive.

• You agree to be honest and sincere when sending out Virtual Gifts. If the Service is abused or the Virtual Gift is not sent out of real interest in the member, we reserve the right to take necessary actions regarding your profile and privileges.

Basic Rules for Video Show:

• You fully understand how the Service works. When you have concerns about the Video Show you viewed, we will review your concern and help you achieve the best available solution.

• We distribute video clips and reserve the right to display and promote other information through the Service, including our website and services, to you in any manner we choose at our sole and absolute discretion.

• Unless otherwise specified, the Service and any content viewed through the Service are for your personal and non-commercial use only and we grant you a limited, non-exclusive, non-transferable license to access the video clips for that purpose. Except for the aforementioned limited license, no rights, title or interest shall be transferred to you.

Prohibited Acts Using Video Show:

• You may not download (other than through page caching necessary for personal use, or as otherwise expressly permitted by the Policy), modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, offer for sale any information contained on or obtained from or through the Service without our written consent. Any unauthorized use of the Service or its contents will terminate the limited license granted by us and can result in the cancellation of your membership on the site.

• You may not use the Service for business or solicitation purposes.

• Any acts which violate the laws or regulations of the country or region of either member is prohibited.

Risks and Disclaimer for Virtual Gifts:

• Members are required to be honest either in sending or replying to a Virtual Gift. However, if members change their minds and decide that you are not the person they are looking for after further communication through the site’s other services or learning more about you, you agree and accept that you will not request a refund of any kind, including in Credits, or for costs spent in association with the site’s other services.

• Members may vary the content of their replies in order to build relationships. Although our site requires all members to provide true and valid information in their replies, we cannot verify or guarantee that the information is 100% accurate. Therefore, we suggest that members evaluate the content independently and use common sense when using the Service.

Risks and Disclaimer for Video Show:

• We provide our members with access to the video clips over the Internet. We reserve the right in our sole and absolute discretion to make changes from time to time and without notice in how we operate the Service. We are constantly making technical adjustments to the Service and often they may not be completely captured within the Policy stated here. As such, they are deemed to come to your attention and agreement through your continuous use of the Service.

• The availability of video clips to instantly watch will change from time to time and from country to country. The quality of the display of the video clips may vary from computer to computer, and may be affected by a variety of factors, such as your location, the bandwidth and/or speed available through your Internet connection.

• We stream some data as a buffer each time you start a video clip. You are responsible for all Internet access charges so please check with your Internet provider for information on possible Internet data usage charges. We make no representations or warranties about the quality of your viewing experience on your computer's display.

Refund and Compensation for Video Show:

In addition to the Guiding Principles on credit and payment refund as stated in the Master Terms of Use of LatamDate, the following refund criteria are specific to the Service:

Credits may be refunded to you if a video clip is proved to be part of a fraudulent act after our investigation.

• Credits cannot be refunded if:

1)  You have clicked and viewed a member's video.

2)  You clicked and viewed again the same video of a member after the 7 days of validity and were therefore charged again for viewing the same video.

3)  The video cannot be played because of your Internet settings or the browser you are using.

4)  In your opinion, there is a difference between the member's profile photos and the images in the video.
